Go Barefoot (www.gobarefoot.travel) is a referral website that aims to provide you with information about and access to Local Tour Operators and accommodation providers. Go Barefoot refers you directly to a Local Tour Operators, who design and operate your travel experience. A Local Tour Operator may be a supplier of travel services itself, or it might be an organiser of travel services based in a local country and who sources accommodation, trips, tours, transport, etc. References to travel services throughout these Terms of Use consist of any travel service provided to you, and any members of your party, by the Local Tour Operator or its sub-contractors, including, but not limited to accommodation, tours, trips, transport, etc.
We do not try to be or claim to be an agent for these providers or an operator of these holidays.

Liabilities

By using Go Barefoot referral website, you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using the website. The website is operated by The Barefoot Enterprise Ltd Limited, a company registered in England and Wales under company number 07850951 whose registered office is at Handel House 95 High Street Middlesex HA8 7DB.

By using Go Barefoot as a referral website, you will enter into a contract with a Local Tour Operator upon any booking, which will be solely responsible for providing the travel service that you choose, based on their separate terms and conditions (whether as the direct suppliers themselves, or as the tour operator organising your travel services for you using their sub-contracted suppliers). For the avoidance of doubt, if a Local Tour Operator is using sub-contracted suppliers to provide travel services to you, then the Local Tour Operator will be still be responsible to you for the provision of those travel services, because the Local Tour Operator has entered into the contract with you to provide those travel services, as principal. Go Barefoot Travel accepts no responsibility or liability for any acts or omissions of the Local Tour Operators with whom you may contract for the services they provide.

For holidays we simply act as a referrer. We are not and do not act as a tour operator, travel arranger or organiser or as an agent for operators and accommodation owners. We make information about the operators and organisers available to you so that you can liaise directly with them to book travel experience. We do not take your money on their behalf or act as go between in any issues relating to your holiday. Your contract will be with Local Tour Operators and they are fully liable for every aspect of their holiday/accommodation product that you buy, according to their own terms and conditions. We strongly urge you to check these carefully in full before you book. Local Tour Operators are free to accept or reject a proposed booking from you.

Go Barefoot does not accept any liability for, or warrant the quality and/or standard of any of the holidays or accommodations that you are sold by the providers that are featured on our website. Go Barefoot makes every effort to ensure that the holiday and accommodation providers featured on our website comply with certain standards, but Go Barefoot is not liable in any way for the way these providers actually deliver your holiday or accommodation to you and this is governed solely by your contract with that specific provider. Without limiting this general statement, Go Barefoot is not liable for any injury and/or damage to persons or property occurring during or as a result of any holiday or accommodation stay taken as a result of enquiries made through this website.

Go Barefoot Travel is not liable for any injury and/or damage to persons or property caused by any actual or alleged libelous statements, infringements of intellectual property or privacy rights, or product liability, whether resulting from negligence or otherwise, including without limitation, from any use or operation of any ideas, instructions, procedures, products or methods contained in the material published on the site. Go Barefoot Travel is also not liable for any copyright infringements.

Local Tour Operator Practices 


We refer Local Tour Operators and tourism service providers based on their ability to fulfill professional and sustainable tourism criteria, including experience, reputation, ethical commitments, quality of service and reliability, as researched by Go Barefoot. We do our best to ensure that all the holiday providers abide by the policies that these operators and accommodation providers claim to follow, but we are not able to guarantee they do at all times. The Local Tour Operator’s booking terms and conditions will be subject to the laws and jurisdiction of the country in which the Local Tour Operator is based, unless stated otherwise.

Go Barefoot Travel does not warrant or guarantee the quality or standard of the travel services by the Local Tour Operators to any particular standard. Should there be any concerns or complaints regarding any travel services purchased by you these must be brought to the attention of the Local Tour Operator by you directly. If we are alerted to bad practice by any of our holiday/accommodation providers we will immediately investigate the matter and take appropriate action in advising them to correct these or removing them from the our website.

We’re not able to assume responsibility for this information and we to disclaim all liability in respect of such information. Go Barefoot Travel endeavours to ensure that such information is accurate and requests that such information from Local Tour Operators is accurate, however Go Barefoot Travel provides no guarantee that such information is accurate. Go Barefoot Travel shall not be held liable in any way whatsoever for any inaccuracy, misunderstanding or expectation drawn from this content.

All referrals and recommendations by Go Barefoot regarding trips, properties and/or destinations are intended for the purpose of information and guidance only and all details should be checked with a provider before you make a booking with them. Whilst we may recommend some holidays for a specific purpose e.g. baby/child friendly products, none of the trips or properties is guaranteed as fully suitable for that purpose e.g. fully child safe or baby friendly, by Go Barefoot.

Any of the material, including pricing and details of travel arrangements, on the website may be out of date or incorrect at any given time and Go Barefoot is under no obligation to update such material, however will use all reasonable endeavours to correct errors or omissions as quickly as practicable after being notified of them. All tours, trips and travel arrangements shown on the website are subject to availability and you must always check with the relevant Local Tour Operator to see whether tours, trips or travel arrangements are available prior to booking. Any links provided on the website are not intended to provide an endorsement by Go Barefoot and Go Barefoot will have no liability or responsibility for the content of this or those website whatsoever.

Price

Listed prices (£ sterling) shown on our site are indicative only and based on a low season departure and group of fours passengers, unless otherwise indicated. The final price quotation is provided directly by the Local Tour Operator following referral. The final price may vary according to currency fluctuations, accommodation standard, group size, season, activities and any other inclusions.

Booking Process

The website includes suggested template itineraries for your consideration, which can adjusted to suit your preference and requests following the referral to the Local Tour Operator. Once referred to a Local Tour Operator, you may communicate directly through any preferred communication medium. You may book tours, trips or other travel services with the referred Local Tour Operator.

A booking is subject to the Local Tour Operator’s terms and conditions and confirmed upon payment receipt of either the deposit or the full cost of the quoted travel service, as requested by the Local Tour Operator. Where you are only paying a deposit to confirm the booking with a Local Tour Operator, you agree to pay the full balance of required monies by the payment date specified by the Local Tour Operator in its booking terms and conditions. Go Barefoot shall not be responsible for any action a Local Tour Operator may take in connection with your booking.

Payments for your travel experience are made directly to the Local Tour Operator’s appropriate account or method as requested, in agreement with their own terms and conditions. Payments made are at your own risk, Go Barefoot is not responsible for any monies transferred to the Local Tour Operator. You confirm that you are at least 18 years old and have full legal authority to enter into any arrangements with the Local Tour Operator. You are and herewith also agree to be financially responsible for full payment for any bookings you make with a Local Tour Operator for yourself and any members of your party.

Please check that all names, dates and timings are correct on receipt of all relevant documents and booking confirmations received from the Local Tour Operator to ensure that these are correct. If you notice any errors in your booking confirmation, please raise this immediately with the Local Tour Operator directly. Any changes required to these details may incur charges that the relevant Local Tour Operator will notify you of. The names given when you book must be the same as in the relevant passport. The information may therefore be provided to public authorities such as customs or immigration if required by them, or as required by law. This applies to any sensitive information that you provide such as details of any disabilities, or dietary and religious requirements. Certain information may also be passed on to security or credit checking companies. In making any booking, you agree that this information can be sent on to the relevant persons.

Cancellation/Amendment

If you need to cancel or amend a confirmed booking, cancellation and/or amendments charges may be payable to a Local Tour Operator, which may be up to 100% of the cost of the travel services booked with a Local Tour Operator. The amount of such charges will depend on the Local Tour Operator’s booking terms and conditions and you should review these prior to making booking. Please ensure that you have any additional insurance required to cover such events and charges that may be applicable to your booking amendment or cancellation with the Local Tour Operator.

Special Requirements & Accessibility


If you or any member of your travelling party has any special needs or a disability which may affect your of their travel, please provide the Local Tour Operator with full details prior to the booking to ensure the suitability of the travel arrangements. It is not our responsibility to ensure that your holiday is suitable for your particular requirements.

Health, Visas & Insurance

Any specific passport and visa requirements for you and all members of your party, or any other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates.

Always seek the advice of your doctor for any questions you may have regarding a medical condition or requirements before considering a holiday or before travelling, together with the relevant passport, visa and travel requirements for the specific destination you intend travelling to, within good time before you travel.

Neither Go Barefoot nor the Local Tour Operators accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements. Most countries now require passports to be valid for at least 6 months after your return date and to have more than one blank page in them.

We strongly advise all members of a travelling party take out suitable personal travel insurance providing cover accidents, injuries, death, and losses that may occur on your travels and for the proper performance of travel services provided to you by the Local Tour Operator.

Disputes

In the event of any dispute between you and a Local Tour Operator, this must be dealt with between you and the Local Tour Operator, as your contract is with them. If you have a problem whilst you are abroad relating to the travel services, you should bring this to the immediate attention of the Local Tour Operator in order to give them the opportunity to investigate and rectify your complaint. Go Barefoot shall not be liable to you in respect of any payments or any other matters in connection with your complaint. Any amounts of compensation, refunds or other monies to which you may be entitled shall be governed solely by the Local Tour Operator’s own booking terms and conditions.

Flights

You are solely responsible for booking all flight elements which you and your party may require to benefit from the travel services you purchase and which are not expressed as an inclusion, including international flights to meet the commencement and conclusion of your trip, as may be required. Where trips offered by the Local Tour Operators on the Website include internal and/or regional flights and where such internal and/or regional flights are expressed as an inclusion of a trip, then these flights are organised by the Local Tour Operator and Go Barefoot Travel does not have any responsibility for their provision.

Go Barefoot does not act as an agent for any airlines. The website may have some links established to flight aggregator sites for potential flights, however Go Barefoot is not responsible in any way for the provision of any flights or other travel services booked through these sites and you are entirely responsible for ensuring that any flights you purchase are suitable for the other travel services you may purchase from Local Tour Operators, including, but not limited to, the correct timings for arrival/departure in the country where you are travelling to/from, as well as any connecting flights and/or transfers required in order for you to benefit from the travel services you purchase.

It is recommended that any flight purchased independently or with a Local Tour Operator is provided by a reputable airline company, one that is not published on the List of Banned Airlines within the EU, and that you have suitable insurances to cover any flights you purchase, as well as any relevant financial protection required to safeguard against failure of an airline to provide the flight(s).
